Services Description

Penkz Care provides non-medical care support and assisted travel services for disabled individuals and senior citizens. Our services are designed to support Clients with daily activities, companionship, and travel assistance.

The specific details, scope, and limitations of the care and travel services will be outlined in a separate Service Agreement or Care Plan, which will be mutually agreed upon before services commence.

Eligibility

To use our services, you must be at least 18 years of age and have the legal capacity to enter into a binding contract. By using our services, you represent and warrant that you meet these eligibility requirements.

For Clients who are unable to consent for themselves, arrangements must be made by a legally authorised representative (such as someone with a Power of Attorney).

User Accounts

To access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

Booking and Payment

Services, particularly assisted travel, must be booked in advance according to our booking procedures. All bookings are subject to availability.

Fees for our services will be provided in a quote or within the Service Agreement. Payment terms, including due dates and accepted methods of payment, will be specified in the Service Agreement.

You agree to pay all charges incurred in accordance with the agreed payment terms.

Cancellation and Refund Policy

Cancellation policies for services, especially assisted travel, will be clearly stated in your Service Agreement. Cancellation may be subject to fees depending on the notice period given.

Refund requests will be handled on a case-by-case basis and in accordance with the terms of your Service Agreement and applicable UK consumer law.

Client Responsibilities

You agree to provide accurate and complete information about your needs, health conditions, and any other relevant information necessary for us to provide safe and effective services.

You are responsible for the behaviour of yourself and any individuals under your care during the provision of our services. We reserve the right to terminate services immediately in cases of abusive, violent, or threatening behaviour towards our staff.

Limitation of Liability

To the fullest extent permitted by law, Penkz Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your use of our website or services.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us for the services in the six months prior to the act giving rise to the liability.

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
